Hello, We had a sub-contractor & general complain to us about sending prelim notices to owners on owner occupied dwellings. In this instance the owner purchase the land and are building a home, per Arizona law this is considered an occupied dwelling. The General on the project mentioned that Cemex sending prelims notice to this particular owner is illegal, since you cannot place a lien on an owner occupied dwelling. Are we wasting resources on sending these prelims even thought we don't have any rights? is there anything I could tell the GC/Sub about these prelims. ?...Read More

I'm a subcontractor, working under a GC on a commercial project in Arizona. Just as anyone does, I "markup" my materials by a percentage. When I get paid, and pay my supply house, they issue me the unconditional waiver for the month of which I paid. I don't like to reveal, nor should I feel I have to reveal, my cost to my GC. Is there anyway for my supplier to issue a waiver based on the month, that does not reveal the dollar amount? I know it doesn't really make sense that it would be possible- since the lien rights say an actual amount, but I thought maybe there was something I don't know about it to help me here....Read More

In April 21 my apartment was burglarized management informed me they didn't have the money or labor to fix the door. I offered my services at a contractor to purchase and repair my door it was given permission to do so only after work was performed materials were purchased I was thrown into collections for non-payment of rent when our agreement was to augment rent and the difference for services I gave receipts and invoice totally $866 minus my rent $670 left $196 still owed to me plus my security deposit $250 totally 444 I gave notice writing and verbally of my moving out. After repairing my door and relocating I was placed in collections for non payment of my rent totally 1971 and because of that the capital investors who have offered me over $150,000 were unable to assist me because of the false collections this has ruined my credit and slandered my good name. Since these false filings several lenders who were interested in my company will no longer associate with me. We have a golf course job in AZ coming up and it is owned by a home builder. Resources state that lien rights in AZ on residential jobs are limited to those with a written contract. does this statement above apply to this golf course as it is not really a residence, it’s a course, but located in a subdivision? We are well past the deadline, but i was wondering if I can send a notice of intent to lien to possible urge them to pay their balance after we have requested for payment to no avail or to maybe get someone to get them to due their do diligence with out any real backlash legally on our end.
