We are a GC doing a job in Arizona. A cash advance company filed a UCC Lien on one of our subs working on this job. It looks like the cash advance company purchased the accounts receivables of our sub for a certain dollar amount, and the sub is now in default. We received a notice of the UCC Lien in the mail and it asks that we forward all funds owed to our sub to the firm representing this cash advance company instead. The UCC lien states that they are aware we owe the sub money, which we do as it's an ongoing job, but the lien does not mention our project at all.
As the GC, we are wary of this and unsure how to proceed. This agreement between our sub and the cash advance company does not include us or our project, and we are not in contract with this 3rd party. We are obligated to pay our sub as we are in contract with them, not this 3rd party. If we don't forward the funds and our sub does not pay the cash advance company, can the cash advance company file a lien on our job? Should we look into issuing joint checks going forward between the sub and cash advance firm? How do we, as the GC, protect ourselves in this situation?

ArizonaSo how would I figure out if I'm an employee or an independent contractor The only thing I have in writing from him or text messages back-and-forth but our agreement was verbal but he did say our agreement in front of other people Because hes over 90 days Delinquent as an extreme urgency dream urgency to me needing to get paid you get paid I am facing an eviction right now And have other bills that are past due and late fees are piling up So I need to get paid as soon as possible
ArizonaOn 3/19/21 I signed a contract with 'Bath Makeover' to install a new bathroom. I gave them $10,000 down. During last 6 months they have giving me lots of excusess why contruction has not started. Can I get a full refund from them as I think this is a 'breach of contrct'? Do they have to start work within so-many days or can this drag on for months more.?

ArizonaWe will be working on a hotel on a bulk room basis, so 20 or so rooms to each invoice, with each invoice following up after closing out the previous 20. Should we send a preliminary notice for each invoice or will one preliminary notice cover the entire length of the job? Is this altered if we provide a final lien waiver after each invoice is completed?

Owner stopped project pending new funding last March
There is no certificate of completion and I am still helping to arrange funding as late as yesterday.

ArizonaThe GC is stating we are in breach of contract because the QP of the contractors license passed away and we have not had a new qualifying party assigned but are in the process of doing so. Since the job has not started can we still be in breach of that contract technically?

ArizonaWhat are my options if a contractor had me sign a contract (I am not a legal representative of the party which owns the property - who are my parents) and the verbal contracts we made have been ignored for that which is written. They have now sent a Twenty Day Preliminary Notice which is addressed to my father's name yet he did not sign the contract. Do I respond to the notice as it was mailed to the property, and I live here but my parents do not.
