There are two different deadlines to file a Colorado mechanics lien. Which one applies depends on whether or not the claimant supplied materials or not.

Colorado lien filing deadlines

For those who only provided labor and no materials to the project, the deadline to file a mechanics lien is after the last day labor was performed, but before 2 months after completion of the improvement. That means the entire improvement, not just the claimant's portion of the work. As for all other lien claimants, the statement of lien must be recorded within 4 months after labor or materials were last furnished to the property by the claimant. Any small or trivial work done, such as punch-list items or remedial work will not extend the deadline.

Extending the CO lien filing deadline

Colorado mechanics lien law does allow for a small extension of time as long as the claimant files a Notice of Extension of Time to File Lien at the county clerk's office within the applicable lien filing deadline. This will extend the time to file the earlier of either (a) 4 months after project completion, or (b) 6 months after filing the extension. <h2>Send a notice of intent to lien before filing</h2> Don't forget, that the state of Colorado requires that a Notice of Intent to lien at least 10 days before recording a lien claim. If the claimant fails to send this notice to the owner and the general contractor, an otherwise valid lien claim will be rejected. This notice is valid once it is mailed by registered or certified mail.
