The mechanics lien process is usually enough to induce payment. However, if you've filed a lien and still haven't been paid, it may be time to consider filing an enforcement action (aka foreclosure action). Under Kentucky mechanics lien laws, once filed, the claim will be effective for 12 months after the claim has been filed. If that deadline is approaching, we recommend sending a Notice of Intent to Foreclose. This isn't a required document, but it's fairly effective at getting the property owner's attention. It's a simple letter stating that if you aren't paid within x amount of days, that you are ready and willing to file a foreclosure action against their property. If this still doesn't get the ball rolling on your money, then you should consult with a local attorney to help you with the enforcement process. We have a few Kentucky-based construction attorneys in our Expert Center Community that may be able to help you. There are some considerations you should take into account before filing the enforcement lawsuit, for more on this see: Should I Foreclose on a Mechanics Lien:?
