Should I send Notice of bond claim

IllinoisBond Claims

I emailed a bond claim to a bonding company on a public job. They replied they received the claim and would be sending proof of claim information. Do I also need to mail out a notice of bond claim to all parties involved?

Illinois bond claimants must send a copy of the bond claim to the project's GC via registered or certified mail, return receipt requested (or by personal service). So, if the GC wasn't mailed a copy of the claim, it's probably a good idea to make sure that happens. After all, it'd be silly to lose rights over failure to send a piece of mail. Further a claimant must "file" the claim with the "officer, board, bureau or department" who awarded the contract, pursuant to 30 ILCS 550/2. So, mailing a copy to the appropriate public agency in charge of the project should also be a priority. But, it's good that the surety could be contacted and is already processing the claim. Getting the ball moving is the first step toward getting paid on a bond claim. But, it's also important to jump through all of the requisite hoops so that payment won't be put in jeopardy due to something like a missed mailing requirement.
