We are a Roofing Contractor performing work for General Contractors/Construction Managers or directly for a Property Owner. Are we required to File a Notice of Commencement with the County for the Project?

A Florida Notice of Commencement (NOC) is typically the property owner's responsibility to file at the outset of each project. In fact, under Fla. Stat. §713.13(1)(g) the "owner must sign the notice of commencement and no one else may be permitted to sign in his or her stead." In some circumstances, this responsibility lies on the shoulders of a construction lender. However, a general (direct) contractor, or subcontractor will never be required to file a Florida NOC. Yes. Notices of Commencement are required on all projects over $2,500.00
