Incorrect information

Level set provide the wrong legal description of a property we have filed a lien on. Please advise on the legal action needed to ensure our legal rights with this lien.

§ 142 of Oklahoma's mechanics lien statute states that the legal property description must appear on an Oklahoma mechanics lien. So, it's certainly important to have a correct legal description on the lien itself. With that being said, having a flawed or incomplete legal description on the lien might not necessarily invalidate the lien in its entirety if the property can be properly identified through the other information on the lien. Of course, since it's required, it's safest to ensure that the description is as accurate as possible.

One way to correct the lien statement might be to file a lien amendment with the updated legal property description. Levelset discusses lien amendments here: Mechanics Liens: Can a Lien be Amended? Alternatively, a lien claimant looking to correct their lien info might be able to file a revised lien claim then remove the prior, flawed lien claim. Granted, it'd be important to remove the prior lien without releasing all lien rights for the particular document.
