How to defeat a lien

If I had a verbal contract with a contractor to do some work at my property which was 100% labor and there was no physical items purchased and there was an agreed value for the job and after the fact but now the contractor changes his mind and says that I owe him more money and has now filed a mechanics lien against my property because I am unwilling to pay what he says I owe him because we agreed to the original price and now the new price is 2 1/2 times the agreed price

I'm sorry about the issues you have experienced. Unfortunately, Idaho is one of the many states that contractors and suppliers are generally allowed to file a lien even if they don't have a written contract. Therefore, an Idaho lien claimant may be working off an oral or verbal agreement, yet they are still able to file a lien claim.  

If you find that the lien filed against you is invalid, there are a few options you can explore including: 

  • Immediately dispute the lien 
  • Force the claimant (a party that filed the lien) to file suit to enforce the lien in a shorter period 
  • Just wait it out
