Does a contractor have to notify the customer of intent to file a lien before he does?

A contractor did work on my house. I paid him in full with 2 different payments. He did not finish the job and the work was unsatisfactory. I pulled back the last payment from my credit card. The job did require a building permit that is still not closed out with a pass or fail tag. The contractor has cut off all communication with me. This is in Albuquerque NM Bernalillo County.

If you are concerned the contractor may take legal action agaist you, you may wish to consider contacting an attorney in your area directly at their office.
