Contractor threatening to place a lien on my property

Hi I hired a general contractor to redo my bathroom, and do a walk in shower. I requested a signed contract but he ignored my request, but furnished me with a detailed estimate. The floor of the tiled shower was not pitched right, neither was the shower threshold, and water was pooling. He redid it once and still not right. I hired a professional tiler to redo/repair it and it cost $1500. We discovered he had tiled over tile the second time! I also had the tiler replace the threshold at the bathroom entrance which was crooked which cost $290. He had also walked off the job with the doorway unpainted and back splash to vanity not installed. He only deducted $1000 off of the bill for shower repair. He added costs to the bill unexpected like $100 for installing the toilet holder and mirror. $50 for "adjusting window" that wasn't on the estimate. He had told me he would take $500 off the bill in May for the fact we had 110V for washing machine (a European all in one) and he had priced for 220V. He didn't in the final invoice. He charged us $100 to vacuum up the debris that fell on my downstairs kitchen ceiling (that has a removable panel in case of plumbing issues) when he has "cleanup" as a part of his estimate. Now he is saying unless he gets the full amount he invoiced me for, he will place a contractor's lien on Monday. I have just been approved for financing for a line of credit but haven't closed yet. I am worried this will mess that up. I planned on sending him a detailed certified letter and paying him the balance after deducting the cost of the tiler, and maint man to finish painting and install the back splash. I have been told I have the Right of Recoupement. Can he still file a lien without a signed contract? I want to deduct the larger amount for the shower repair, plus the other things I mentioned, but don't want a lien on my hose. He will NOT negotiate at all. What can I do?

In order to file a Massachusetts, a written contract must be in place. A written contract is clearly required by § 2 of the state's mechanics lien statute, and "any written contract enforceable under the laws of the commonwealth" is acceptable as a "written contract." Now, determining whether or not a detailed estimate would be considered a "written contract" is a bit more of a detailed endeavor. However, Chis Strang of Strang, Scott, Giroux & Young, LLP does an excellent job of breaking down exactly what will qualify as a written contract for the purposes of filing a Massachusetts mechanics lien: Do You Have a Contract You Can Lien On?. In Mr. Strang's article, he notes that documents that are not explicitly "contracts" have been sufficient as long as certain other requirements were met - like sufficient terms and a signature. So, even if a traditional contract has not been executed, there are some situations where a written document between the parties might constitute a "contract" under Massachusetts contract law. Right to recoupment I'm not aware of any right to recoupment established in Massachusetts for an owner against their contractor who has performed defective work. Generally, if a contractor has performed defective work, an owner may be able to recover the cost of repairing that work, and the owner may attempt to deduct that from the price owed to their contractor. However, I'm no expert on Massachusetts construction defect law or the recovery process when defective work has been performed. So, for more clarity there, it's probably worth getting input from a Massachusetts construction attorney. Preventing a lien filing Keep in mind that, regardless of whether the lien would ultimately be valid and enforceable, that lien could actually still be filed by the contractor. Generally, recorders offices have neither the bandwidth nor the authority to investigate each claim filed. So, a contractor could record their lien - even if flawed - and that lien could cause issues, including issues with obtaining a credit line against the home being liened. However, if it's crucially important that a mechanics lien not be filed, Massachusetts property owners are generally entitled to file a blanket payment bond which would protect their property from mechanics lien claims filed for work done on their property. With that payment bond in place, a claimant would have to look to the bond for recovery rather than making their claim against the property, itself. Of course, securing such a bond can be expensive, and a contractor would still ultimately be able to make a claim against the bond. What's more, if a lien claim is filed against the project property without a payment bond in place, the property owner may still typically bond off the filed lien claim. By securing a bond designed to specifically relieve the project property from a filed lien, an owner can make sure their property does not remain encumbered - which can help if the property will be used for a line of credit. But, much like a blanket payment bond, bonding off a lien can be expensive. And, the claim doesn't just disappear when it's bonded off. I am under contract with a contractor in Louisiana after the devestating hurricane Laura. I have paid a huge amount to the contractor . Nothing is complete except the roof. He is asking for $20,000+. I will pay when something is finished ( like my outdoor shed ) He immediately threaten me with a lien. Work was stopped on Dec 15th and until yesterday Jan 12th hen he built a ramp and demanded money. So far he has been paid $44700. Very hard to talk to, he gets angry and calls me rude and ignorant. Am I at fault for expecting at least one project finished before giving him another big payment ?

After the devastating storm Laura, I had a contract with a contractor in Louisiana. I gave the contractor a significant sum of money. All everything except from the roof are finished. He is asking for $20,000. He quickly threatened me with a lien, but I told him I would pay when anything was done (like my outside shed).
