Can I file a Mechanics Lien on a project that I did not send a 20-Day Preliminary Notice on?

We are a subcontractor working on a Community College project. We did not send a 20-Day Preliminary notice on this project, however, we do complete Conditional and Unconditional waivers for our client. We are not receiving payment on an executed change order and are wondering if we are able to file a mechanics lien on this project?

If this is a public works project for a California public entity, you do not have lien rights but may have the right to serve a Stop Payment Notice on the owner and GC (if you timely and properly served a preliminary notice) or a serve payment bond claim, but may need legal assistance in doing so.
