Can I file a mechanics lien?

We are a contractor just finishing a commercial T&I and getting little to no response on payment of contract and change orders. Can we file a lien?

You can as long as you sent a prelimiary 20-day notice at the appropriate time and you delivered labor or materials to the project. If you did not, you still have a claim for breach of contract or unjust enrichment. Simply because you don't have lien rights does not mean that you aren't owed the money. It just means that the debt is not secured by a lien on the property. Whether or not it is worth filing a lawsuit depends on the amount of money owed and the strength of your case.

If you are not getting paid from your efforts, you could let a licensed and bonded certified commercial collection agency collect the debt owed without having to pay any upfront money and only pay a small percentage upon the successful collectio of the account.
