Can I file a mechanics lien?

CaliforniaLien DeadlinesMechanics Lien

I am a material supplier working on a project in California. Final materials were supplied 10/6. Net 30 payment was due on 11/6/20. How long do I have to file a lien on the project?

The general deadline to file a California mechanics lien is 90 days from the completion of the project as a whole. However, if a Notice of Completion or Cessation has been filed, then the deadline for material suppliers is cut to just 30 days after such notice was filed.

Good luck!

As a you have 30 days from recordation of a Notice of Completion (NOC) to record a lien, or 90 days after completion of the project (not just your scope of work, but the entire work of improvement) if no NOC is recorded. If you direclty contracted wiht the owner, you have 60 days from recordation of a NOC to record a lien, or 90 days after completion of the entire project if no NOC is recorded. You must file suit within 90 days of recording the lien. Hopefully you served a 20-day preliminary notice, if you did not contract directly with the owner.
