Can a cleaning company file a mechanics lien for unpaid labor in the state of Florida?

My cleaning company cleans at a GC's main office. They have canceled service without reason and refused to pay for an outstanding invoice. Can I file a mechanic's lien on this GC's property... even though this was not a construction project?

Unfortunately, cleaning services usually do not fall under the protection of mechanics liens in Florida. This issue was addressed by Florida courts back in 2011, where they held that a mechanics lien filed by a cleaning services company for a condo association was invalid. Typically, lienable services require some sort of improvement to the property. There may be some circumstances where a mechanics lien could be appropriate, such as cleanup during a construction project; but it's not likely. There are still other options for recovery. Sending a demand letter threatening litigation could prove effective. Or, the debt can be passed off to a collection service. Lastly, if all else fails, a lawsuit claiming breach of contract can be filed in small claims court. Good luck!
