Were are the GC on jobs in St Charles, LA - per the lien requirements - looks like there is pre notice that should be sent if the job is over 100,000.00 before you start the project. We did not do this. Should I file the pre notice? we have been on the job since 8/29/20 and it is going to be greater than 100,000. 00. I am the GC on a single condo remodel. This is considered a commercial project by building department and the contract is with the unit owner. The owner has paid every bill next day until the final bill. Now they don't want to pay until they receive receipts for materials and paid invoices from contractors. This was never discussed before now and I don't have the material receipts they want and would not typically provide them as they have my special contractor pricing that is not to be released to the public as it causes obvious problems with everyone wanting that price. The trades are not paid in full as I need the final payment to do that and I have provide what is owed and contact for each trade to customer. Our contract also calls out I get 20% of cost and names items. The client went and purchased these items and then tells me they have taken care of it and not to worry but that's how I get paid. Can I bill for those items 20% and what to do about them wanting receipts? the bill has not changed for two months and several payments have been made with no question or request for receipts. On the paint in particular I charged the customer what it would have cost him to buy it and I delivered it to job. I feel I have been more than fair. Hi. Would like to verify lien filing deadlines when working as a sub under a GC in California. It's my understanding that a sub's lien filing deadline is 90 days since it's last day on the jobsite. However, a new GC client of ours is insisting that it's 90 days from the completion of the entire project, regardless of when we finished our work. Please clarify and confirm what is correct. I was hired and have a signed agreement as a subcontractor by a restoration company that holds a GC license. The home was damaged in a fire and the company was hired to complete the entire restoration to the home. They have completed the work except for the covered screen lanai that I was hired to build. They have an NOC and their permit has not been closed out yet. The homeowner has refused to sign a new NOC for the screen enclosure portion of the job. My boyfriend has been living with me for over 3 years. We got in fight and he threatened me with contractors/mechanics lien. He has done a lot of work in house, outbuildings and property. However has done so with on site materials and donated material. Walls, electric, etc.. are not up to code. He has also ran 2 trucks and 1 car. Into the ground. I have a five year warranty on the workmanship of a metal roof. A few weeks after it was finished the new roof leaked around the chimney staining the ceiling in the house. I texted the contractor and told him about it. He said he had the flu but he would make sure it would be fixed when he got better. A few weeks later he sent one of his guys to fix it. The roof is gray and the flashing around the chimney is gray, everything is gray. It was repaired with black caulking. I texted the gentlemen again and asked why did he use black because the roof is gray. He texted me back saying that it was just temporary, it was done before the cold set in. He said they were going to refresh the flashing. I was satisfied that it would be done in the spring. Then covid came, I'm 64 with three underlying health conditions. I didn't want to be around any of them so I didn't rush the job. I eventually assumed that the guy had forgotten about it. I still waited hoping everything would get better. I finally decided in August to contact him because things were not going to get better and it had been long enough. Remember, I have a five year warranty, signed and dated by him and a text saying it was a temporary fix. I found out that the man who owned the company and who signed and dated the contract had died and his wife had layed off the workers and closed the business. There is a lot of other people besides me who had that warranty. His daughter, who worked in the office for him is refusing to help me. Again, the leak started a few weeks after the roof was installed. The leaking was stopped but I don't like it being repaired in black with everything else gray. We filed a 20 day notice on September 21 to the GC and Project owner and then the building owner September 28th for work completed in September. This commercial private project started actually in June and we finished September 26th. We were paid up until until August 1st and then did work for 2 weeks in August and 2-3 weeks in September. The project will probably complete by very early October. Is the owner and general contractor still obligated to send out a notice of completion even with such a late filing of the 20 day notice? In other words just because the 20 day notice is very close to the end of the project does not remove the obligation for the owner to notify us of completion from which we would then have 30 days to file a lien? Secondly should we file a lien for work only in September or also include August recognizing that the work in August might not be covered under the lien as it is outside the 20 day window.
