I have a 2 part question. I am a designer and make my money on materials. I was working with a licensed general contractor. My contracts have both my business name (not my personal name) and the general contractors. The checks get payable to my company "Keystone LLC", the company pays the contractor for his work and he pays all subs. I want to make sure I am ok with receiving payment this way.
The second part to my question is: My general contractor performed a project where the customer utterly refused to pay us their balance of nearly $20k. No reason just don't feel like it. I already paid the general contractor and the subs... so that money should now be reimbursed to me.
The customer has a lawyer friend who is representing them. I then had to get a lawyer now too. I am passed the 90 days of mechanics lean filing in my state. The jobs is technically pending because the attorneys are playing back and forth. My attorney is wanting me to sue but I much rather file the lien.
BTW: the general contractor didn't file the lien because everyone has already been paid by me. But the customer has not paid. Help :) ...Read More
Im getting ready to close on a piece of property to a person who leased the property for last 2 years. They entered into a contract with a construction contractor to erect a metal building. The leasing party did not pay them in full. After repeatedly sending invoices, the contractor placed a mechanic's lien on my land approximately 8 months after they performed work on the project.
