It is not illegal and not even that unusual to demand unconditional waivers before disbursements. I find it troubling but it is a reality in the construction business. If you do not get paid, you can still file a lien and fight it out. Whether it will be enforceable will depend in part on whether the owner makes a payment to the GC in good faith reliance on the waiver and can show prejudice if the lien is enforced.See More...
You can file a lien but if at all possible do it within 4 months of you last day of work. You can also file suit for breach of contract or other quasi contract claims.See More...
