I had provided service to a mortgage center(bank) on a property all authorized work by the bank was paid . The buyer contacted me to provide additional service , since he was still waiting to close escrow and did not want to waste time he asked if i could start the work and as soon as he closed the escrow he would pay. i did not obtain a signature on a new work order from him because he refuse, saying he was not legally the new owner until escrow closes and declare him owner , then he be able to make payments for repairs on that property . At this time the buyer and the agent do not respond to my calls, emails , etc. The time frame is almost closed just waiting on them to respond the work was done back in May 2018 . Client stopped project, my signed contract said "If for any reason the project is stopped, the full team fees will be paid immediately". The have charged a late fee of 5% and said they would pay and now are back peddling after the invoice was sent three weeks ago. They are also terminating people or asking to negotiate. I have a deferred comp receivable claim submitted in December 2017 of roughly $340, 000 for services rendered to build the first project for a new clean coal technology. I also have a roughly $ 1 million claim for non-cause termination severance (as CEO) from the company (an NZ C Corp, but operating out of Phoenix) that employed me under an independent contractor relationship from 2012-17. The first project has not yet been defined or funded, but the likely locations are in AZ, CO and TX. Any funding ($10-50 M dependent on the location) will be secured by the project and/or by intellectual property consisting of 8 patents and business plan/basic designs held by the company. I developed the business plans and basic designs, and I participated in the development of the patents. I would like my lien to place me in priority for payment against first project funding or the sale of any intellectual property or stock in the company. I still own 21.1% of the company. I am the general contractor and I was advise by an attorney that since the signed contract wasn't signed before i started fixing the home; I cannot file my lien. Even though its only been 60 days since homeowners prevent us from finishing the work. Attorney said if I don't file the signed contract with the clerk BEFORE fixing a home then I will never be able to file a lien....Read More

I had an unlicensed person go into my house to a complete a job and provide accurate report in CA on a water issue and HVAC. He said all work for $300 repairs plus report with pics and $35/hr. It was no contract just oral we argued and got it to $275 for all work and accurate report with pics. He came out in 10 mins and did not give me an accurate report, hid facts and plus did not work on the HVAC just poked it and next day another inspector went in and reported work not done. I am still offering to pay $35/he per his ask and extra $20 as compensation to turn a hot water valve on ON. He threatens to sue and put a lien etc. Am I obligated to pay more and can he do this to us?...Read More

I have lived in my grandmother house for 30 years and took over the bills. She moved in with my sister about 5 years ago. Since than I have paid all property taxes and insurance. Just this year I spent over 40,000 getting electrical and plumbing done. I also added a room and shower. My sister came out of nowhere and says she wants to sale the house. Is there anything I can do to protect myself and all the money i have invested....Read More

We provided services that we were unpaid for. The work was done in NYC for 2 residences. Our business partner who is the licensed Master Plumber in NYC did the work on our behalf. We have in our possession signed contracts which are payable to our company and paid our business partner from our monies for the work that was done. We have not received payment from the firm which hired us and also have outstanding balances on work that was billed directly to homeowner. If we are not a licensed GC in NYC but the plumber who performed the work is licensed in NYC are we still able to place a mechanics lien on the two residences the work was performed in order to attempt to collect the unpaid balances?...Read More

We built and financed daughter's house and hold a promissory note and deed of trust for 300k. There were options to renegotiate terms if they went over that amount but we didn't do that, we just kept the receipts to deal with it at the end of construction.My husband is licensed contractor in CA. Our company completed a private project in Louisiana as a general contractor on 6/26/18 (substantial completion). Our company hired a subcontractor to perform a specific scope of work as part of this project. We later had to terminate the services of the subcontractor due to multiple performance and schedule issues. The subcontractor abandoned the jobsite on 5/11/18, then we filed a Notice of Default with the subcontractor on 5/15/18, and finally filed a Notice of Termination with the subcontractor on 5/17/18. Our company then had to complete the specific scope of work of this subcontractor, and complete the overall project. My questions: 1. What lien rights does this subcontractor have against the owner property, and 2. What are the deadlines for the subcontractor to file a lien? Our company has filed a Notice of Completion with the local parish clerks office for the overall project based on completion date of 6/26/18 and a Notice of Termination with the local parish clerks office against the subcontractor in question for their specific scope of work based on termination date of 5/17/18....Read More
