Single Family Home in NY, Sentricon Termite bate system was installed by last owner with 1 year contract, Contract states that the bait system remains the property of Sentricon.
The house is sold 3 months later, New owner never signed any contract with the pest control company.
9 months after sale the Pest control company asks for renewal fee for the contract or removal of the bait system. The new owner does not allow them on the property to remove the bait system and refuses to renew a contract that was not signed by him.

I own my own consulting company and worked as owner's rep and later Project Manager for the same companies for three years. I originally worked for the owner of several commercial buildings and then was transferred to work for a related construction company that was run by an investor in the buildings and we worked only on the buildings owned by this same company.
At the end of my work, they asked me to accept partial pay as they were experiencing cash flow issues. I agreed, but when I told them that I could not continue to defer my pay, they terminated me. I have been talking to them weekly for almost 90 days and have several promises to pay my back pay but only one token payment. I now think that I need to file a lien to collect my pay but do not know if I fit into one of the two exemptions for notice of intent to file lien. Since I am only one employee, can I qualify as a laborer or does my job description prevent this? I only have 3 days to file the lien....Read More

5C is currently supplying one to five material hauling trucks to a local concrete company. We are picking up sand and rock for the concrete company and delivering it to their plant for use in their concrete mixes.
We began providing the services 5/15/17 and have done so most everyday since. I would say there hasn't been more than 2-3 days break in the work at a time. Does that have an impact on the "start date" of the project? If we are eligible to file a Mechanics Lien is it too late to submit the 20 day _preliminary notice? I understand that it would only grant us back through the beginning of November.
Thank you!...Read More

I feel like we are correct in beginning the lien process - started the NTO's - (We were hired directly by an Owner's Designee to negotiate the telecom agreements at existing properties - no building permits) but I have some concern that our client may lash out and make it difficult/expensive for us by suing us for incorrectly filing a lien or slandering them to their lenders by falsely claiming we made an egregious claim. Need some support here!...Read More

Our company provided labor as a subcontractor to a primary contractor for a residential homeowner. The contractor is more than 30 days past due on their payment to us. It is not our customary practice to send preliminary lien notices to homeowners so we missed the 20 day window to submit one to the homeowner. What recourse do we have in recording a lien for the unpaid invoice?...Read More
Currently we have a project that is at 95% complete, due to some issues we have been notified that we will not be finishing the project and another general contractor has been hired to finish the last 5%. we have only been paid to approx 75% completion and the balance owed to us just for the last bit of work. Currently we are owed 11500. just for the work that was done. Can we now proceed to file a lien because they won't pay us or do we need to invoice them and have it rejected? I notice the law uses the term at completion but technically the job isn't complete yet and we won't be completing it so can we not file until the other contractor completes the project. Just looking for guidance so when we do file the lien its in the proper order of operations and at the correct junctures of the project.
