Hello, We have a contract in Wisconsin with KSW Construction. The situation is as follows: Contract amount is $74,550, of which we have been paid $63,275.00, leaving a balance of $11,275.00 (before including our Change Order). Once we include our Change Order for the additional labor done on 3 demising wall openings in the amount of $12,000.00 (which has not been approved), this brings our total contract amount to $86,550.00, bringing the total amount stilled owed to us to $23,275.00. Once we take into consideration KSW's deductive Change Order (which I will not sign until they sign ours) in the amount of $11,320.00, this lowers the amount owed to us to $11,955.00 (assuming all goes as planned). Our last day at the jobsite was 27NOV,2020. I was under the impression that along with the sate of Illinois, we had 90 days from our last date onsite to submit our preliminary notice to the GC. I was just informed by our Illinois mechanics lien attorney, Steve Goba, that each state has its own mechanics lien regulations/restrictions. Your help in this matter would be greatly appreciated. I am a small roofing & waterproofing subcontractor. A MN based contractor hired my company for services on a public project (rest stop owned by WISDOT). The state did not require a bond on this job. The contractor had failed to meet manufacturer warranty requirements and we are the company who handles warranty issues for MN and surrounding states. The inspector marked the defects that needed to be fixed to spec before the warranty could be issued, but did not supply how many (each/lf/sf). We sent an estimate to give pricing for each type of service. It stated that this was not a complete estimate and the final bill would reflect that. The owner was onsite and was aware of the scope of the project. They didn't pay the bill upon completion as required. It took 3 months to get the check and it was only for the amount of the estimate. We have never had non-payment from a client and didn't realize that we had POSSIBLY missed deadlines for the preliminary notice. I did send the intent to lien notice as required. When I read up on liens in WI I was under the impression that in this instance I wasn't required to file the preliminary notice. The notice of intent was sent within the required time frame and I have 10 days to file/send the actual Lien. However, I have also been warned that if I file the lien without having met all the requirements then I open myself up to litigation which I do not want to do. I need to be sure I can file this lien or what recourse is available to me if that is not possible....Read More

Hi there. I’m in the process of getting all of the contents for my intent to lien letter. I completed work for a tenant within a commercial building and never received payment. As for my intent to lien; I purchased a copy of the deed online for the property but I’m curious as to if it will be valid or not. I’m unsure if I need to add the “suite/unit” number of the exact unit I preformed work on. Also am curious as to what a legal property description looks like because on the deed, it only has the state, city and county along with it’s document number. Thank you!...Read More

Last year my basement flooded. I hired a company to waterproof and resurface the floor. The contractor suggested a "2 inch skim coat." It is cracked beyond belief and curling at intersections, not bonded, sealed or reinforced.. Obviously poured so wet that concrete is splashed up the wall and onto the ceiling. Contractor refused my request for delivery ticket as did Redi Mix plant. Contractor stated had he followed ready mix plant's instructions, he would have had to cut control joints every four feet. He is trying to tell me I have less cracks than cuts. At least forty concrete professionals state this work is unacceptable. He did not pour the floor properly. I took him to small claims but asked the judge to move to civil court as estimate to tear out basement and replace are $25,000.. Attorney tells me he would take most of my award and I still would not have a floor. Contractors insurance company cant understand why I would report this to the state. Dates were falsified on his intent to file a mechanics lien. I dont know if he is bonded.1) Not economically feasible to take to court. 2) Ins company trying not to pay 3) DATCP OF Wisconsin refused to assist me as in legal limbo. I did a job for a old friend. He works for another company, and got the job from a home owner he knows. A tree fell threw the roof and then needed the front half of the roof torn down and reframed. I was asked to do the job at a hourly wage which I accepted. He then screwed over me and the owner of the company. The owner of the company came down from where he is located and stopped the job. I haven't been payed by the home owner, owner of the construction company or the friend that works the company....Read More
