I am a homeowner who hired handyman for a back porch repair. He said his fee was $50 an hour. When I asked for his estimate he said it would be $400 to $500 dollars total. I agreed to the $500. This was all verbal. I paid the costs of lumber and paint from Home Depot including delivery. This project was replacing the stairs and small porch treads and painting the existing railing. He said the existing structure holding the old stairs was sturdy. The handyman was very slow. Upon completion, he said I owed him $1300 for his labor of 26 hours. I gave him a check for $600 which was $100 over his estimated dollar amount of $500. He accepted it. Now, he claims he will put a lien on my home for the difference of $700 for his version of our verbal agreement. He refused to acknowledge that he gave us an estimate of $400 to $500 in front of me and my husband. How should I respond? Should I file a Date of Completion including a copy of the check given to him? ...Read More

We have a customer where there was a problem on a her plumbing job. We paid to have the shower redone. she is still sending us invoices for supplies that she says we owe. I am willing to pay her these final invoices but I want to send a letter with the payment saying something like: By cashing this check you release Manwill Plumbing from all further liability ........ Can you help me with a letter like that? I just want her to know we have paid for our mistake and we will no longer be paying her anything else. ...Read More

Our company provided construction labor and some construction supplies on a project in bountiful Utah. It was a cost plus agreement. We started the project in June, were paid timely for our first invoice, July paid timely for our second invoice. Came back in October after the custom material had been delivered under the same agreement. Once our last invoice was sent, the property owner contested the invoice and only paid about 30% and has since been very difficult to get an answer from as to his intentions on paying. Our company in based out of Idaho. The last date that we worked on the property was on October 24th, 2019. Are we still within our lien rights for Utah? We have made weekly attempts to communicate. For the last four weeks the property owner is seeming to stall, giving no real answers as to his intentions. What would you suggest? Thanks ...Read More
