I am a material supplier on a job here in Texas. We provided ready mix concrete on a job, our customer was a sub contractor. The GC and Owner are the same entity. I have only been paid about half of the $20,645.28 that I am owed on the project. The Owner/GC has paid the sub (my customer) and he signed a lien waiver. I sent them the monthly notice but just received an email from them stating they are disputing it because they paid the subcontracor. My question is, is the lien still valid since I have no been paid and did not sign a waiver?...Read More

I have a customer that is adamant that they shouldn't be billed for sales tax because they are paying the sales tax on the full amount of the project but can't supply me with a direct pay certificate. I went through a tax audit last year and they confirmed I was doing everything correctly in regards to a rental as stated in the Texas Comptroller ruling #3.294, so no tax due. I believe that they should remove all rentals from their project and pay the sales tax on the balance. So they have paid for everything except for the sales tax billed. Can I file a lien on just the taxes due?...Read More

I am a sub sub contractor to an electrician. He owed me money on two projects and thankfully on the larger project I was able to get a copay check from the GC. I think this has made the contractor decide not to pay me for the other project which he owes $9,519.20. I have long since missed any chance to file a lien on the project. I'm not sure if this falls under supplier to supplier category, but I think it may. We are a materials supplier and are considering working with a concrete plant where the materials we supply and deliver will be blended into the concrete that is then delivered out to another job site. I believe we would fall as a Tier 1 supplier and my question would be can we file against the job where the concrete was delivered if we do not receive payment from the concrete plant who originally hired us to deliver the material to be blended?...Read More

A sub was not paid by his GC for work performed in December of 2021. On May 16 of 2022, the sub's lawyer filed a Lien against the homeowner. On the affidavit, the date was backdated to April 12. However, the official county clerk's filing record shows its "Filing and Redording Date: 05/16/2022 2:01 PM". Has the sub missed the deadline or it's OK to file late as long as your affidavit date was marked within the deadline?...Read More

We are the HVAC suppliers on a private job in Texas; Our customer is going to purchase equipment that will be stored in a facility for a period of time BEFORE reaching the jobsite. Are "stored materials" lien notices filed on in the same manner as normal purchases? Or are there special timelines for stored material. How are our lien rights effective if we stored the materials in an offsite storage facility we are paying for vs a storage room the customer is paying for? Thank you ! I'm not a contractor nor do I have a license, but I was approached by a woman in January to rig down a truck mounted drilling rig (small scale for geotechnical sampling) mounted on a Ford F550, design, fabricate, and remount the same rig and get it ready for operation. I finished on April 13th, sent an itemized invoice payable on May 9th, a very reasonable amount of $1,050, she paid half the invoice but will not return messages or calls now, even though I have sent a notice of past due. She told me the truck/rig would be put up for sale, point being if she has or does, I won't see another dime. I don't have a contract but I have plenty of proof the work was requested by her, an invoice was requested by her, statements by her that she would pay by the due date, and that the work was completed, tested, and turned over to her.
