hello, I own a heating and air company we did work for a builder building a residential custom home and the builder is stating that the customer is not paying him therefore he cannot pay us. Am I able to file a lien on the property? or what is my course of action?
TennesseeMy company has sent all required Lien documentation to both Contractor and City. Surety Company has taken over project and to the best of my knowledge the contract is not completed. I have reached out to surety company to get update and a they sent me a Claim Acknowledgment form to complete.
TennesseeI am new to the construction industry and am trying to learn all I can regarding Lien Rights/Waivers/Law (etc). I am curious if we receive timely payment from a customer for their first month on the job and did not send a notice. What happens if the do not pay for the remainder of the project? Do we still have the opportunity to send a notice to secure the lien rights for the remaining amount of the project?
TennesseeI am an interior designer and helped a coworker with their home renovation. I designed it and also set up all the contractors to do the work on the remodel. At the end of the project, the homeowner wouldn't pay us for the last week of work. I filed a Mechanics Lien and now he is claiming that the work wasn't done well and he had to rip out all the work we did and redo everything. Is it possible for him to sue me for the amount of money he spent on the renovation when I was in charge? I do not own a business nor am I a general contractor, so I'm guessing he would have to sue me as an individual. I just don't want that to happen so I am trying to navigate my next steps carefully. My neighbor has performed many plumbing jobs for me. I hired him to plumb some fixtures and let him know that I would be providing the materials needed, which also included instructions for proper installation of the fixtures.
He chose to use his own materials, ignore the instructions, and in doing so, rendered some of the functionality of the restroom unusable. I have since paid him, but tried to negotiate a refund for the improperly performed labor, or a fix at a discounted labor rate. He agreed to neither options. I have considered disputing the charge on my credit card, but he has since threatened to file a mechanic's lien against me. Does he have legal grounds to do so if he performed the work improperly and I dispute the charge?

The lady I had handling this sort of thing has passed. She originally sent off paperwork but I don't even know what point in the process she was. I do know she supposedly sent off the publication for the newspaper. Last thing I heard was that the title loan people didnt want to come and get it. Im simply trying to clear space on my yard and sell it. please help
TennesseeI have had an illegal mechanic lien on my property. General session judge told him to remove he didn't have a right but he still hasn't removed it. Judge told me I have to go to circuit court to remove. But I don't know what form I need to fill out. He was a tenant and put lien on to harass me.
TennesseeThe general contractor we are working for keeps telling me about my "paid when paid," agreement with them. I've been telling them that "paid when paid" is null when it comes to liens because I have 90 days from my final inspection to lien. My customer is not going to have paid me in full by the time 90 days is up. Do I still file a lien because my 90 days is up? They are making a payment this week but far from in full. Thanks

We are now receiving calls from subcontractors who completed work on our house, but our contractor has not paid them. Are we legally responsible to pay these AGAIN since we have already paid our contractor for said work?

TennesseeI work as a sub contractor for a sub contractor. I have not been paid for the work I have done. I started the job getting paid by the job and half way through the job the sub contractor I was working for put me on payroll. Still haven’t been paid.
