A client for who we completed a full house renovation ended up losing money on the property and subsequently didn’t pay our final payment. We gave them over three months, during that time they completely ignored all correspondence. Once they received an offer on the property and the lien was found by the closing company they were forced to communicate with us. They gave a sob story about losing money and asked if we could negotiate from $7,232.00 to $4,000.00. I said absolutely not, but finally agreed to $6,500.00 to just be done with the situation. I sent an invoice and she responded with this email:
Hi Diana,
Sorry for the delay, I am just checking with our escrow company and waiting to hear. We would like to pay you part on card toward the invoice and then leave the rest until you submit the release of lien doc's to escrow. Does that sound ok? They will confirm they have the funds from us and will release them to you once she receives those. Does that sound ok? I just want both parties to feel ensured of getting as per agreement.

I have never had to file before so I’m a little uneducated on the subject, but this sounds strange to me. They already showed their intentions when they ignored us for three months until they received an offer and were forced to communicate. Should I stand firm with total payment before releasing?

We renovated an entire house for a flipper who had very little experience. After purchase price, hard loan company, our total, HVAC and a roofer he ended up losing money on the property at the amount he had to list it for. He did not pay our final Installment of over 7k. He’s fully aware we filed. I purchased the expedited service which was received by the recorder today, but it looks as though he’s trying to push through an offer he received yesterday (seen it on Zillow & Realtor). His real estate agent, who was the one who referred him to us, is also aware of the lien. Is there a chance they could have done a search for liens already and the unsuspecting home buyer will end up with a lien on their new property? We are a drilling company that worked for a General Contractor (GC) on a Pipeline job that will not settle out valid invoices. Our equipment was set up on Prop A for a 1100 foot underground bore shot that went under various residential properties. Can we legally include these properties in the lien filing along withe the GC & Project Owners? We want to ensure we are perfecting this lien correctly....Read More
If the lien waiver states all materials supplied as of release date of 4/30/18 must have been paid in full but the subcontractor only supplied the amount paid as of 4/30/18 but all invoices up to 4/30/18 were not paid, does that (if signed) waive lien rights for the material not paid up to the release date?
The bottom of the form shows the correct amount paid through the 4/30/18 release date.

Lien amount was incorrect on both Notice of Intent to Lien and on the Lien itself. i had the amount corrected on the Notice of Intent to Lien and now want it corrected on the lien itself. i know there is a 30-day waiting period after filing the notice before you file the lien. does that go for the amendment as well? i ask because we are going to run into our lien deadline (6 months after materials delivered)....Read More
A notice of Mechanics Lien Claim came in the mail, but it was for only $300. Pennsylvania states liens can only be placed that exceed $500. How do I get it removed using this knowledge?...Read More
