I was given information from my lawyer to set up a construction account. I read your blog on the construction trust account. I need to set it up correctly but here is the question. Who needs to do that ? In other words does it need to be set up by a lawyer or a CPA because no one seems to know. I did set up an account at the bank and labeled it construction account but not sure if that is sufficient?

Do I need to file a mechanics lien? Or do I need to do some other kind of contract agreement. I did some construction work on my friends house a couple years ago and he was going to pay me when he was able to get the money to do so. He has decided to sell his house and I want to make sure to protect myself for the monies owed to me and I was wondering if a mechanics lien could be filed so that the title doesn't get transferred until my bill is satisfied. ...Read More

Can an equipment lessor file a mechanics lien in Texas if they do not have a written contract with the Property Owner? If the equipment lessor is hired by a Subcontactor, is that Subcontractor required to have a written contract with the Property Owner for the lower tiered parties to retain lien rights??

When filing a TX 4th month notice (a Lien) and I have a 2nd and 3rd month notice also being filed, do I amend the 4th month notice or file multiple fourth month notices?
We have multiple jobs where we file a 2nd, then 3rd, then its time for the 4th. We currently do not aggregate all outstanding debt for that job to the fourth month notice we file the fourth, and then any subsequent filings for the additional 2nd and 3rd months notices as required. Our concern is what do we do with the additional amounts when they come due for their own fourth month notice. File another or amend the original?...Read More
