I am a subcontractor who has worked on a non-public construction project in Iowa. My last day on site was 17 February 2022. I haven't received payment from the general contractor and I would like to make a claim under the Payment Bond (form A312). My questions are: - Is there a maximum period of 30 days to make such claim? - If there is, do the 30 days start counting from completion of the project as whole or from completion of the works which the subcontractor has performed? - Is the action therefore time-barred or am I still entitled to make the claim? - If I am entitled to make a claim, is there a specific form I should use? Hello, We are a metal building construction company doing a project for a community college, therefore, a state/government job. We are a subcontractor under a general contractor. The general contractor is not paying us. The project is in the state of Iowa. I understand that a mechanic's lien cannot be filed as the property is not personal property. A bond claim will need to be filed. What is the procedure? We did not foresee this situation, therefore, a preliminary note was not delivered to the general contractor at the start of the project. We are a small company who lost the major job supporting our operation. We were slow pay to our supplier and they filed a lien against a job that was subcontracted to us. We have been making payments to the supplier every Friday as agreed. The job is not at substantial completion, located in Iowa, owned by the state of Iowa. We have a second job in NE with a lien as well. That job is complete. Both projects are holding our funds until the liens are removed, we can't pay without the funds. We are willing for the funds to go directly to the supplier but can't seem to make that happen. Any information is GREATLY appreciated....Read More
