An owner/management company requested a lien waiver from my subcontractor after the project was complete and the sub was already paid. It was an unconditional lien waiver and signed by the sub, as I interpret, relinquishing lien rights no matter what the value stated. It was returned to me by the owner/management co. with the request to add a $ value to allow my payment. I changed the $0.00 to $1000.00 had the sub execute and redelivered the lien waiver with a final payment sum included. I am trying to disguise the amounts paid to the subs to the owner for obvious reasons....Read More

I have sent a notice of intent to lien to all parties as required by Illinois law. What I didn't do, was send the 60 day preliminary notice for an owner occupied project (which this was). My question is do I still have to/ or should I send the 60 day preliminary notice even though I have a ready sent a notice of intent ?...Read More

I recently placed an order for a NOI to lien. When I was hired as a sub-contractor the house was completely gutted(so no one lived there). Would I still need to do a 60 day preliminary notice when the owners moved out temporarily while construction was going on and only moved back in when the certificate of occupancy was issued by the village?...Read More
