We had process a lien and we haven't got paid, we need to move forward what is the next step to proceed.
We have not being contact by the property owner, and we will like to collect payment. We need assistance in how to proceed.
IllinoisAn owner/management company requested a lien waiver from my subcontractor after the project was complete and the sub was already paid. It was an unconditional lien waiver and signed by the sub, as I interpret, relinquishing lien rights no matter what the value stated. It was returned to me by the owner/management co. with the request to add a $ value to allow my payment. I changed the $0.00 to $1000.00 had the sub execute and redelivered the lien waiver with a final payment sum included.
I am trying to disguise the amounts paid to the subs to the owner for obvious reasons.
IllinoisI have sent a notice of intent to lien to all parties as required by Illinois law. What I didn't do, was send the 60 day preliminary notice for an owner occupied project (which this was). My question is do I still have to/ or should I send the 60 day preliminary notice even though I have a ready sent a notice of intent ?
IllinoisI recently placed an order for a NOI to lien. When I was hired as a sub-contractor the house was completely gutted(so no one lived there). Would I still need to do a 60 day preliminary notice when the owners moved out temporarily while construction was going on and only moved back in when the certificate of occupancy was issued by the village?
