Hello, I am filing a lien for a homeowner who hasn't paid me since August. I am trying to claim $3,000 for the soffit and facia for their house and garage, plus late fees, interest fees, attorney fees, and filing fees. Would you be able to advise me of a better, more professional way to word it to put under "services" when filing a lien? Thank you.

You seek a "better" way to describe the services that form the basis of your Mechanics Lien. Actually, there is nothing wrong with describing the basis ofy our lien as "service and materials." That said, however, I also notice that you wish to include "late fees, interest fees, attorney fees, and filing fees" in the liened amount.

The Illinois Mechanics Lien Act provides that only "work and materials" employed in making "improvements" to the property shals be the basis for a lien. That would exclude late fees, interest, attorneys' fees, and filing fees. While certain professional fees can be the basis for a lien, attorneys' fees are not among them. Finally, remember that overstating a lien can lead to its dismissal.
