Hello, In Texas, an affidavit of commencement (affidavit of filing of contract) is not required. You may file one if you wish but a lot of county clerks may not know what you're trying to do. Are you sure you mean "affidavit of filing contract" or rather "affidavit of completion"?  Frankly I have not heard of an affidavit of filing a contract.  However, lenders often need an affidavit of completion, usually by the contractor, before they make an advance to the owner.  The obligation to file the affidavit is on the owner who in turn might ask it of the contractor.
