I need to file a lien notice. We are a parts supplier providing to another supplier, who sold to a GC that is installing a dock for an OA. The parts seem to be at the marina location in a parking lot. The state the part's are in is Ohio, and the supplier we sold them too is located in Indiana. Who does the lien get filed with? I am thinking the OA that owns the Marina, but thought I would check to make sure before filing the lien.
Your assumption is basically correct. In Ohio and other states, the mechanic's lien is filed against the benefitted property. It sounds like you sold parts, and those parts were to be used in the construction of a dock at a marina, and that you have not been paid for those parts.
In that case, the lien would be filed against the property that the marina/dock sits on, as you explained, but the owner of that property may be different than the OA in your scenario.
If you did not serve notice of furnishing before suppying the materials, you may want to first check to see if a notice of commencement was ever recorded by the owner. If a notice of commencement was recorded, you may run into issues with your mechanic's lien if a notice of furnishing was not served.
