Unfortunately, suppliers to suppliers do not have mechanics lien rights in Georgia. Under OCGA §44-14-361(a)(6) regarding who has the right to file a lien, it states tat "All contractors, all subcontractors, and materialmen furnishing material to subcontractors." (emphasis added) This is relatively common as suppliers to suppliers are rarely afforded lien rights.
Therefore, your legal options to recover for non-payment will be limited to claims against your customer for breach of contract or unjust enrichment. These claims may be brought up in GA small claims court if the amount in dispute is under $15K. In any case, you may want to contact a local attorney to help advise you on your specific circumstances. We have a few Georgia-based attorneys in our Expert Center Community that may be able to assist you.
Good luck!
