Right to File a Wisconsin Lien
The Wisconsin mechanics lien laws grant lien rights to a broad spectrum of construction project participants. Under WSA §779.01, a mechanics lien is available for any person who performs, furnishes, or procures any work, labor, service, materials, plans or specifications, used or consumed for the improvement of the land. Therefore, anyone who provides labor, materials, or services to a construction project (regardless of their tier) will have the right to file a WI lien.
Required Wisconsin Lien Notices
However, there are some required WI preliminary noticesto secure the right to file. Suppliers are required to send a Subcontractor Identification Notice within 60 days of first providing labor or materials to the project; this notice may be sent late, but will only cover labor and materials provided after the owner receives the notice. In addition to this, a Notice of Intent to Lienmust be sent at least 30 days before filing your lien claim, and within 5 months after last furnishing labor or materials.
