When is it too late to file a Notice of Commencement?

OhioNotice of Commencement
Anonymous Contractor

I am acting as the property owner and a Notice of Commencement was not filed when work started 3 months ago. Work is now furnished and we just received a Notice of Furnishing from one of the general contractors sub contractor. Can I still file a Notice of Commencement?

Generally, a Notice of Commencement can be filed late in Ohio and still be useful. However, if the work is complete, I'm not sure how effective a Notice of Commencement will be. Still, it might be worthwhile to file the document anyway since it could help identify who's working on the job (if additional Notices of Furnishing are sent) and may provide some potential mechanics lien protection.
