When filing a lien on an oil and gas operator due to non payment of their equipment rental, do we list just the operator, or the land owner(s), as well?

KansasMechanics Lien

One of our customers is an oil and gas E&P company/operator. They drilled and operate two wells in Kansas. They are not paying for the rental of our equipment, so we pulled our equipment off location. On the lien, do we list just the name of our customer, or the name(s) of anyone who has an interest in the oil wells?

Good question! When utilizing a mechanics lien to recover payment, the filed lien will ultimately attach to the property - not to any specific company. As a result, when a mechanics lien is filed, such a lien must typically contain the information of the property owner where the improvement is located. Such is the case in Kansas. Under § 60-1102(a)(1) of the Kansas lien statute, a Kansas mechanics lien must include "The name of the owner" among other required information. Further, § 60-1103(a)(1) also requires that the mechanics lien must state the name of the party who hired the lien claimant. zlien discusses other information regarding Kansas liens - such as who can file, mechanics lien deadlines, and what amounts might be included in a lien claim - at the following resource: Kansas Lien & Notice FAQs. Further, there's a step-by-step guide to help Kansas claimants who wish to file lien claims here: How to File a Kansas Mechanics Lien.
