After you record a mechanic's lien you have 90 days to file legal action to foreclose that lien. If you fail to do so within 90 days of recording the lien, it will expire and you will need to release the lien whether or not you have been paid.

If you are early on within the 90 days window, I recommend sending a demand letter to the developer demanding payment and asserting your intention to move ahead with foreclosure of the lien if you are not paid.

But if you are within the last two weeks of this 90 day period, you need to prepare to file legal action to enforce the lien if you intend to do so.

If you require legal assistance with either a demand letter, or to file your action, email me at ryan@huntortmann.com to schedule a free consultation.
