What type of notice should be sent to the GC about force majeure that may delay the project?

CaliforniaCoronavirus

With the Coronavirus, i have some employees not wanting to come to work and some that do. Is there a force majeure notice i can send to the GC that covers me if delays start to happen?

You need to read your contract language carefully first. Usually you will have specific provisions in the agreement; if there is a flow down provision, you need to review the prime contract as well. There is not necessarily magic language but you should consider carefully choosing your terms in your notice to match your force majeure/delay provision, and get the notice out sooner rather than later.

Not all contracts contain a force majeure provision so make sure that yours does. If it doesn't, it can make it more things more difficult. If you do have a provision, I agree you should try to use the wording in the provision as much as possible in your notice. It would be a good idea to have your notice reviewed by an attorney before you send it.
