What should I file to protect our lien rights?

We are a General Contractor however we are supplying labor and material on an upcoming project. We will be working as a subcontractor working for another general contractor and would like to protect our lien rights. The Owner and General Contractor have not supplied us with a Notice of Commencement.

Since you have a direct contract with the GC, you don‘t have to do anything because you’re protected under the law. Howver, you can always prepare a document called a Notice of Preliminary Lien Rights, which must be filed within 30 days of first beginning work. It has a similar effect as a lien. Think of it as a “pre-lien.”
