What’s our options

ColoradoMechanics Lien

We hired a general contractor to remodel do 2 bathrooms. After he said he was done we noticed issues with his work. He didn’t do what he was hired to do. The wall was not completely done the bathroom door was not hung properly and the shower didn’t drain properly. We brought these to his attention and he came out a couple more times and didn’t fix any of the issues he refused the redo the shower floor and only did half of the wall and didn’t touch the door. He once again said he was done with the project There is more to the issues regarding tearing out the bathroom months before he starting the construction etc We had to hire someone else to fix his mistakes and now he is putting a lien on the house for the final payment that we didn’t pay since he didn’t do the work properly as promised

I am sorry for the issues. As for the lien, unless you have some loan or other agreement that requires you to clear all liens, that is likely irrelevant. It is unlikely that the contractor will foreclose the lien. They may sue, however, but that is just a maybe. As to your options, that is pretty simple. You sue, hopefully, and hopefully collect. If the amount at issue is below $25,000, this is county court. You will need to follow the notice of claim process and that entails getting an expert. Reach out to construction attorneys on the issues and process.
