What options do I have if a lien was not filed before 120 days

ArizonaMechanics Lien

Hi, I am an A/C contractor. We did a new build for Desert Star Homes back in July 2020. The homeowner moved in in July as well. We have not been paid, and did not file a lien. Do we have any options at this point ?

Just because you may have lost your lien rights does not mean you are not owed the money. If the deadline has passed, you can sue the general contractor for breach of contract (if you are a subcontractor) or you can sue the homeowner directly for breach of contract (if you have a contract with the homeowner). If you don't have a contract with the homeowner, you can still sue them for unjust enrichment. You should speak to a lawyer first to determine the best way to proceed if you are going to go the litigation route. Feel free to call or email me 602-234-7849 jab@jhc.law
