What is the best way to get paid?

Arizona

I did not file a preliminary lien and I believe we are over the 120 days since substantial completion. My verbal contract was with an unlicensed general contractor who claims he has not been paid by the owner of the commercial property where the work was done. What is the best way for us to try to recoup $75,000 of the money we spent on this project?

Generally, there are remedies for nonpayment in law and equity. Choosing the best strategic path is determined by analyzing the specific facts of a situation including consideration of past, present, and potential future relationships with the other parties involved along with scrutinizing "contract" terms. Payment solution options vary. Feel free to contact me for a confidential discussion at 303-319-2924.

Since the contractor is not licensed a few options are not available. You will likely need to sue under and you have various claims under law and under equity. There could be other options depending on the facts and this project, but to know that would require talking to an attorney. Reach out to an attorney soon to consider options and they can help you avoid problems like this going forward.
