In Missouri, there is a limited availability of actions arising from an "implied warranty." Generally, Missouri imposes a warranty of quality and fitness for a newly built house and the integral parts of the structure on the builder-contractor, but this warranty is strictly and narrowly defined, and only applicable to the original construction of the house. The warranty does not apply to subsequent improvements, and does not transfer to subsequent purchasers. Further, the implied warranties can be disclaimed by the developer / builder-contractor, provided certain specific words disclaiming the implied warranty are used in the contract. There may also be express warranties set forth in the construction contract itself. These warranties may be very strictly specified, or may be a general warranty that the work is to be performed in a "workmanlike manner."
