We have finished on site work and billed retainage. The general contractor says the overall job is not finished even though our electrical work has been finished since October. However they requested some documents which we completed in January. Is the last day worked in October or January. If it is October then our lien deadline is close and we need to file since they have not paid our October invoice.
Your last day worked would be the last day work was performed on the project on site. But for lien deadline purposes the only thing that matters is the final completion date for the entire project. This will be determined by actual completion, the recording of a notice of completion or notice of cessation, or a continuous cessation of all labor for 60 days. If a notice of completion or notice of cessation is file, you will have 30 days from that notice to record your lien. Otherwise you will have 90 days from actual completion for 150 days from the beginning of a continuous cessation of labor for 60 days.
