Sold real estate taxes take priority over any other liens on property (whether a mortgage lien, mechanics lien, etc.). Why? First, that is the law. Second, the County wants its property taxes, and the Courts are county offices. If there is a conflict between your private interest and the public interest of the County, who do you think will prevail? Did you guess the County? Then you're right!

You want to preserve your right to collect on your Mechanics Lien? Then redeem the owner's property taxes. That can be expensive, but you could certainly attempt to collect from the owner in your Mechanics Lien foreclosure lawsuit.

I hope this informaiton was helpful. I recommend sitting down with a knowledgable Attorney to discuss your options in more detail. Best of luck!
