What form do I need to file to get the superior court clerk to release my bond money back to me since my notice of contest has expired?

GeorgiaBonding Off Lien

I bonded over a lien on my property on and filed a notice of contest on the same day. The clerk of court WILL NOT TELL ME what form I need to file to have my money released back to me since the notice of contest has expired and the lien claimant has done nothing. The clerk said it was legal advice that she could not give out . . . I said it's procedural not legal! Nevertheless, I need to know what I need to file for to get my bond money back.

Georgia's mechanics lien statute doesn't provide any guidance on how to get your bond returned after the mechanics lien has expired. So, unfortunately, I'm not able to provide much help here. But, contacting one of these Georgia construction attorneys could be helpful - if they've got experience with bonded off liens, then they should be able to set you on the right path. Alternatively, reaching out to the surety company who's provided the mechanics lien bond should provide some insight as well since they'll likely be familiar with that process.
