You have a number of options available to you, but the easiest first step is to send them a demand letter. This can come from you directly, but it often has more impact if it comes from an attorney they represents you. Depending on the type of project (residential or commercial), you may have some additional remedies available to you that would bring the customer to the table. Good afternoon. Your question is easier than we often see. You should probably put in writing and email and voicemail that "this" is your last attempt to secure payment due, after which you will involve your attorney, who will then have to pursue the customer for payment or file a lawsuit. Depending on the amount at issue, if it is under $15,000, you yourself can also easily file a breach of contract suit for collections in the Special Civil Part of the Superior Court of New Jersey in your county. The forms and process there are fairly simple and the process is quicker than a full lawsuit in the Law Division. In any event, the threat of involving legal may be enough to achieve action and payment. If the response is some threat of suit against you, for instance a Consumer Fraud Act claim, then that is time to retain an attorney.
