Remember, a preliminary notice covers work performed 20 days before a preliminary notice is served. If you’re beyond that period you wouldn’t have the right to record a mechanics lien, serve a stop payment notice and, in some cases, not make a claim on a payment bond. That’s the bad news. The good news is that while you will have waived your statutory payment remedies you could still pursue a claim for breach of contract and pursue other non-statutory claims.
