What course of action should I take, and do I have a legal case to prosecute them for wrongful assignment of a lien?

I had a lien placed on my property (MORTGAGE) from a delivery service affiliated with my fathers restaurant in Sanford, ME in 2014, and I am just learning of it today. I had no ownership of this restaurant. I haven't worked there since I was a kid. However, my father and I share a name, which was the name of the restaurant. I do have a different middle name, but they assigned the lien to me anyway without proper notice or checking to verify the owner. They blindly assigned the lien to me. I've been in touch with the assigned lawyer of the creditor, and they are making this difficult for me to verify my identity vs my fathers identity. I don't speak to my father. I am currently in the process of getting a loan for a pool for me and my kids. This whole process is being held up as a result. I need this erroneous lien removed.

If a lien has been improperly filed against your property and you need it immediately removed, it'd be wise to consult with a local Maine attorney about what options will be available for removal. Generally, though, if a baseless lien has been filed - then the owner will be able to pursue legal action and potentially even receive damages due to an improper lien. And, threatening to file legal claims could be enough to get the lien removed, especially if you can make it extremely obvious the lien is baseless.
