What can I do if we miss deadline to file to enforce?

Had a lien filed, but the deadline to file to enforced it was 5 months ago.

Your lien is extinguished and you can no longer foreclose on the lien.

However, you can sue on the underlying transaction. You will need to consult with an attorney for more details, in part because there isn't enough information with your answer to say anything else. Your local attorney will need information and documents from the underlying deal to tell you more about the cost, risks, and possible benefits of pursuing your claim in court. There's nothing wrong with that. In fact, I typically skip the lien and simply sue on the contract claim. The lien doesn't add much unless there are a lot of people not getting paid or if the project is under a construction loan so the property owner has to get the lien resolved in order to avoid other problems (including transitioning to a conventional loan).
