We filed a lien in 2021 in Texas and would like to start the foreclosure process. How do we do that?
In order to foreclose on your lien you will need to bring a lawsuit for foreclosure in the county in which the lien is located. I highly recommend you hire an attorney to initiate suit. Note that if you filed the lien as an LLC or some other type of business entity, such as a limited partnership or corporation, you will be required to hire an attorney, as you cannot represent a business entity in Texas pro se.
In most cases, the lawsuit to foreclose on the lien must be brought within 2 years of the deadline for filing your lien. This means you may not have a lot of time to initiate suit. I would contact an attorney about this issue as soon as you are able to.
