The owner was sent the notice and the lien at the same time within the 45 days required

Owner claims he was not notified prior to the lien being filed. He claims he should have been notified when the work was started. My reading of the statute says that the notice must be given within 45 days from when the work was started. I need to know how to respond best. The owner is trying to go around my lien and claiming it will cost me more in attorney fees then the lien amount to fight this. As I see it, it is his fight. He needs a lien release from me for work done.

Was your contract with the owner or were you a subcontractor?

If you are a sub, its 45 days from first furnishing. If your contract is with the owner - there is no notice requirement.
